Terms of Service

These Terms of Service (the "Terms") govern the use of the GirlsApp service, available at girlsapp.pink, hereinafter jointly referred to as the "Service".

The Service is a SaaS platform providing an automated AI assistant for the WhatsApp messenger, designed for small businesses, independent entrepreneurs and professionals.

By registering on the Website and/or using the Service, the User unconditionally accepts these Terms. If the User does not agree with the Terms, they must immediately stop using the Service.

Access to the Service requires creating an account. The User agrees to:

• provide accurate, current and complete information upon registration;
• keep this information up to date;
• keep their password confidential;
• be fully responsible for all activity on their account;
• immediately notify GirlsApp of any unauthorized use of their account.

The User must be at least 18 years old or have the consent of a legal representative.

The Service offers several plans:

• Free — a free plan with limited functionality for evaluation.
• Starter / Pro / Enterprise — paid plans, the conditions and price of which are indicated on the pricing page.

Paid plans are provided on a monthly or yearly subscription basis. The subscription is activated immediately after payment confirmation and is valid until the indicated expiration date.

The User may change or cancel their subscription at any time from their dashboard. Cancellation takes effect at the end of the current billed period.

Subscription payments are made in cryptocurrency (Bitcoin and other supported currencies) via the CoinRemitter payment processor. Prices are indicated in US dollars (USD) and converted to the corresponding cryptocurrency at the rate applicable when the invoice is generated.

Important: cryptocurrency transactions are final and irreversible. Once a transaction is confirmed on the blockchain, refund is technically impossible.

An invoice is valid for 30 minutes. After this period, a new invoice must be generated. The subscription is automatically activated after transaction confirmation on the blockchain (usually 1–3 confirmations).

Due to the nature of cryptocurrency payments and the immediate provision of digital services, the User expressly acknowledges and agrees that the right of withdrawal does not apply to purchases made on the Service.

Refunds are only possible in the event of a technical inability of GirlsApp to provide the Service, and only within 7 days of payment. All refund requests must be sent to support@girlsapp.pink.

The User agrees not to use the Service to:

• send spam or unsolicited messages;
• distribute malicious code, viruses or malware;
• infringe the rights of third parties (intellectual property, privacy, etc.);
• engage in illegal or fraudulent activities;
• attempt to hack, reverse-engineer or compromise the Service;
• share credentials with third parties without written consent;
• violate WhatsApp Business API terms of use.

GirlsApp reserves the right to suspend or terminate the User's account in case of violation of these terms, without prior notice and without refund.

GirlsApp strives to ensure 24/7 availability of the Service but cannot guarantee uninterrupted operation. The Service may be temporarily unavailable due to maintenance, updates, failures or force majeure events.

GirlsApp is not responsible for interruptions caused by third-party service providers (WhatsApp, hosting, payment processors, etc.).

The Service, its source code, design, graphics, texts, logos and all related elements are the exclusive property of GirlsApp and are protected by copyright law.

The User is granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. Any other use is forbidden without written consent.

To the maximum extent permitted by law, GirlsApp is not liable for indirect, incidental, special or consequential damages, including but not limited to: loss of profit, data, customers or reputation.

The total liability of GirlsApp towards the User is in any case limited to the amount actually paid by the User for the Service during the 12 months preceding the event giving rise to the liability.

The processing of the User's personal data is governed by our Privacy Policy, which forms an integral part of these Terms.

By using the Service, the User acknowledges and expressly agrees that GirlsApp Team may process and use Service usage data in an aggregated and fully anonymized form that prevents any direct or indirect identification of a specific User or their customers.

This aggregated data may notably be used to:

• improve, debug and develop the functionality of the Service (including AI models);
• run internal analytics, measure load and monitor performance;
• produce de-identified market and industry reports (for example: average conversation length, response time, most popular languages, country trends), which may be published or shared with third parties;
• produce de-identified benchmarks available to subscribers as an additional Service feature;
• train and fine-tune internal machine-learning models.

GirlsApp Team never sells and never shares with third parties any identifiable personal data of Users or their customers (phone numbers, names, message content, individual revenue, etc.) for commercial purposes. Any data monetization is carried out exclusively on the basis of aggregated, de-identified metrics that are irreversibly stripped of any re-identification capability, in line with GDPR (Recital 26).

Should the User wish to object to the use of their data even in anonymized form, they may send a request to privacy@girlsapp.pink. Requests are reviewed individually in accordance with applicable law.

GirlsApp reserves the right to modify these Terms at any time. The User will be notified of any material changes by email or via a notification on the Website at least 30 days before they take effect.

Continued use of the Service after the changes take effect constitutes the User's acceptance of the new Terms.

The User may terminate these Terms at any time by deleting their account via the "Settings" section of their dashboard. Account deletion is final.

GirlsApp may terminate the Terms with the User in case of violation of these terms, fraudulent activities or other serious grounds.

These Terms are governed by the laws of Ukraine. Any dispute arising in connection with the Terms will, where possible, be resolved through negotiation. In the event that an amicable resolution is not possible, disputes shall be submitted to the exclusive jurisdiction of the competent Ukrainian courts.
